Program description

The Microsoft Technical Communities program ("Program") is focused on Microsoft’s broad engagement with user group leaders, speakers and communities from around the world ("You"). Through both our field and corporate engagement, we look to enable user group leaders with content, tools, online resources, offers, events, and promotions to help keep their community active and a value to their members. We also look to assist You in Your community management efforts by connecting You with other global user group leaders to share ideas, content and best practices. Program members’ community and event information is made available to the public through the Program website, providing member communities with additional opportunities for visibility and engagement.

What these terms cover

These Terms are comprised of the below PROGRAM TERMS, GENERAL TERMS, AND U.S. TERMS (applicable only if You live in the United States). These Terms are an agreement between You and Microsoft Corporation (or, based on where You live, one of its affiliates) that describes Your rights and responsibilities while using the Program and Program website ("Service"). The Service includes any and all offers, activities, contests, promotions and events ("Offers and Events"), access to documents, photographs, videos, and other graphical, textual or audio-visual content ("Content"), software, including developer tools, code snippets, and sample code ("Software"), this website ("Site") and communication forums and other services. These Terms apply only to Your access and use of the Service and not to any other Microsoft sites, products, content, or services. From time to time, specific Offers and Events might be presented to You in connection with the Service and such Offers and Events might be subject to their own terms and conditions, in addition to these Terms. You should review the entirety of these Terms, including any linked sites, because all are important and together create this agreement that applies to You. PROGRAM TERMS

Roles of Microsoft Technical Communities members

Applicants to the Program must register as either a Speaker or Leader. There are no required responsibilities within the Program that these roles must perform.

Registered Leader

By selecting this role, You agree that You are currently involved in running and managing a user group, community, chapter or non-profit organization that is focused on providing Microsoft-focused content and dialog for IT Professionals and/or Developers who are members. You give Your time to manage, schedule and facilitate meetings, dialog, training sessions, special events and other activities that benefit Your membership. You are identified as a part of the membership board, council or leadership team and have permission from Your organization to make executive decisions in the organization’s name.

Registered Speaker

By selecting this role, You have identified Yourself as someone who has experience and knowledge on specific technical topics that You can share with others. You also are someone that has presented to medium size to large audiences on these topics. You may be a seasoned IT Professional or Developer, Microsoft Certified Trainer, Microsoft Valued Professional, or Microsoft Partner who makes themselves available for speaking engagements that can benefit Your local or global communities.

Contests and Sweepstakes

Subject to your local law, you may also be eligible to enter into certain contests and sweepstakes sponsored by the Program from time to time ("Promotions"). Notwithstanding anything herein to the contrary, each Promotion offered via the Program is governed by these Terms and the unique Promotion Official Rules which will set forth any unique eligibility requirements, entry criteria, entry deadlines, entry limits, winner selection dates and prizing. Microsoft reserves the right to amend or modify the rules or duration of any Promotion in its sole discretion.

GENERAL TERMS

Using the Service

When using the service, you must comply with these terms, all applicable laws, and the Code of Conduct and Anti-Spam Policy.

Eligibility

You may not participate in the Program unless You meet the eligibility criteria below ("Eligibility Criteria"). By participating in the Program you represent and warrant that you meet the following Eligibility Criteria:

Embargoed Countries

If You are in an Embargoed Country, You may not participate in the Program, or receive any software or paid services through the Program. For the purposes of these Terms, "Embargoed Countries" include: Cuba, Iran, North Korea, Sudan (not including the Republic of South Sudan) and Syria.

Privacy and protection of Your personal information

Your privacy is important to Microsoft. See the Privacy Statement for disclosures relating to the collection and use of Your information. The Program is intended to help community leaders worldwide to connect to Microsoft, speakers and other community leaders. Your membership in this Program allows Microsoft and other members of the MSTC to communicate with You. If You do not wish to connect to Microsoft and other members of the MSTC program, You should not join this Program.

The personal information You provide about Yourself, such as the components of Your community profile, are accessible and may be used by Microsoft and other members of the Program

Annual renewal

The Program requires that members confirm certain personal and community information each year upon their first sign-in on or after January 1st in order to continue membership. The Program may make Your community information (name, address, and URL) and event information publicly available through the Program website, by RSS feed or through other channels related to the Program.

Program communication

Microsoft will administer the Program membership and benefits through the technicalcommunity.com website and Program communications from techcoms@microsoft.com. Your membership in the program allows Microsoft to communicate with You on the following Program topics:

Additionally, other Program members will be able to contact You through Your registered email address or registered social media profiles.

Changes to the Terms, Service and cancellation

Microsoft may update the Terms at any time without notice to You. You can view the applicable and most current version of the Terms by clicking on the hypertext link located at the bottom of the webpage. Microsoft may change the Program or delete or discontinue features, available software or other content at any time and for any reason (or no reason). We may cancel or suspend Your access to the Program at any time. Our cancellation or suspension may be without cause and/or without notice. Upon cancellation, Your right to participate in the Program stops immediately.

If You are a member of the Program and would like to cancel Your membership, You may do so at any time by emailing the Program helpdesk at techcoms@microsoft.com. If You send an email requesting cancellation of Your membership, please be sure to say "CANCEL MSTC MEMBERSHIP" in the subject line.

Member account, password and security

If any part of the Program requires You to open an account, You must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. You are entirely responsible for maintaining the confidentiality of Your password and account. Furthermore, You are entirely responsible for any and all activities that occur under Your account. You agree to notify Microsoft immediately of any unauthorized use of Your account or any other breach of security. Microsoft will not be liable for any loss that You may incur as a result of someone else using Your password or account, either with or without Your knowledge. However, You could be held liable for losses incurred by Microsoft or another party due to someone else using Your account or password. You may not use anyone else's account without the permission of the account holder.

Unsolicited ideas

Microsoft and its employees do not accept or consider unsolicited ideas. This includes ideas for new advertisement campaigns, promotions, products, technologies, processes, materials, marketing plans, and product names. Please do not send any artwork, samples, demos, or other works to Microsoft or anyone at Microsoft . The purpose of this policy is to avoid misunderstandings or disputes when Microsoft’s products or marketing strategies seem similar to ideas submitted to Microsoft. If You send them anyway, please understand that Microsoft will not treat your ideas or materials as confidential or proprietary .

If You post any feedback in connection with Your use of the Service or provide any feedback to Microsoft, You give Microsoft an irrevocable, perpetual, worldwide, royalty-free, sublicensable right to use, share, and commercialize Your feedback in any way and for any purpose. You also give to third parties any patent rights in Your feedback needed for their products, technologies, and services to use or interface with any specific parts of a Microsoft software or service at no charge. You will not give feedback that is subject to a license or other obligation that requires Microsoft to grant or pass through any rights or make any disclosures or payments to third parties. These rights survive these Terms.

Your contributions

Microsoft does not claim ownership of any content or software You provide through the Program (Your "Contributions"). Your Contributions remain Your own. Microsoft does not control, verify, or endorse the Contributions that You and others make available.

You control who may access Your Contributions. Please do not post Contributions that are proprietary or confidential information, or code that You would like to retain control over. If You share Contributions in public areas of this website or in shared areas available to others You have chosen, then anyone You have shared Contributions with may use those Contributions. . When You give others, including Microsoft, access to Your Contributions on this website, You grant them a free, perpetual, worldwide, irrevocable, nonexclusive license to make, use, sell, market, have made, import, modify, create derivative works from, reproduce, distribute, publicly perform, publicly display, and transmit the Contributions in any field of use, product or service, with rights to sublicense these same rights to others through multiple tiers. . You grant these rights solely in connection with Your use of the Service and other products and services made available by Microsoft. Data that is deleted may be irretrievable.

Microsoft Content

Use of the Microsoft content is governed by the terms of the license agreement, if any, that accompanies or is included with the content. If any Microsoft content is made available to You on this website without a license agreement, then You may make a reasonable number of copies of the content for Your internal use in designing, developing, and testing Your software, products and services. You must preserve any copyright notice in all copies of the content and ensure that both the copyright notice and this permission notice appear in those copies.

Accredited educational institutions, such as K-12 schools, universities, private or public colleges, and state community colleges, may download and reproduce Microsoft content for distribution in the classroom for educational purposes. All information available in those portions of this website or concerning content or software available in those portions of this website are confidential information of Microsoft. For a period of five years from the time You accessed this confidential information, You may not disclose this confidential information to any third party. This restriction will not apply to any information that is or becomes publicly available without a breach of this restriction, was lawfully known to the receiver of the information without an obligation to keep it confidential, is received from another source who can disclose it lawfully and without an obligation to keep it confidential, or is independently developed. APIs and Software

If Microsoft publishes information on application programming interfaces ("APIs") through the Program, Microsoft will not assert any of its patent rights on account of Your products calling these APIs in order to receive services from the Microsoft product that exposes the APIs.

Microsoft may have patents, patent applications, trademarks, copyrights, or other intellectual property rights covering subject matter in the content, software or services. Except as expressly provided in any written license agreement from Microsoft, the furnishing of content, software or services does not give You any license to these patents, trademarks, copyrights, or other intellectual property.

If Microsoft provides software to You as part of the Program, its use is governed by the license presented with the software; if no such license is presented, these terms apply. Microsoft reserves all other rights to the software not expressly granted under these Terms. If Microsoft makes any software marked as "sample" or "example" available on the website without a license agreement, then it is licensed to You under the terms of the Microsoft Limited Public License.

If Microsoft makes any other software available through the service without a license agreement, You may use it solely to design, develop and test Your programs to run on Microsoft products and services.

All Microsoft software that is made available to You for download or execution from this website is the copyrighted work of Microsoft. If Microsoft provides any software to Your computer’s browser (such as JavaScript) and does not include a license agreement, then Microsoft grants You the right to use that software solely to interact through Your browser with the service or this website. .

PROHIBITIED ACTIVITES IN USING YOUR LICENSE

In using this Site and participating in the Program, You hereby agree to refrain from any of the following prohibited activities:

Taxes. Microsoft is not liable for any taxes that You are legally obligated to pay in connection with any sponsorship funds or prizes granted under the Program. Any sponsorship provided by Microsoft in connection with the Program is inclusive of tax (including but not limited to federal, state or local net income or gross receipts taxes, sales, use, and value added taxes) and any tax reporting or payment will be Your responsibility. You agree to indemnify and hold Microsoft harmless from any taxes or claims, causes of action, costs (including, without limitation, reasonable attorneys’ fees), penalties, and any other liabilities related to such taxes.

Miscellaneous; Entire Agreement. If any part of these Terms is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that honors the allocation of risks in these Terms, and the remainder of these Terms shall continue in effect. These Terms, the Privacy Statement, Official Rules and Sweepstakes Details and any related consents or agreements that You provide during Your participation in the Program, together with any End User License acquired via the Site, constitute the entire agreement between You and Microsoft with respect to the Program and supersede all other (prior or contemporaneous) communications and proposals, whether electronic, oral or written, between You and Microsoft.

Internet. Microsoft is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of promotion materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive information by Microsoft or participant on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. If for any reason the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Microsoft which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this program, Microsoft reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the program.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, MICROSOFT RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

GENERAL LEGAL PROVISIONS APPLICABLE TO ALL PROGRAM PARTICIPANTS

Microsoft Contracting Entity. The Microsoft contracting entity for these Terms is determined by the country/region You are located in, as detailed below:

Legal limitations. Use of the Site is not authorized in any jurisdiction that does not give effect to all provisions of these Terms. To the fullest extent allowed by applicable law, such disputes must be brought by You within one year of the date You are entitled to bring any lawsuit or other action. Microsoft’s performance of these Terms is subject to existing laws and legal process, and You agree that Microsoft may comply with law enforcement or regulatory requests or requirements notwithstanding any contrary term of these Terms.

Applicable law; attorney’s fees. Applicable law, jurisdiction and venue for these Terms are identified below. This choice of jurisdiction and venue does not prevent either party from seeking injunctive relief with respect to a violation of intellectual property rights, confidentiality obligations or enforcement of recognition of any award or order in any appropriate jurisdiction. If either party commences litigation in connection with these Terms, the prevailing party will be entitled to recover its reasonable attorneys’ fees, costs and other expenses.
